Welcome to HarborReel

These Terms of Service govern your use of the HarborReel streaming platform. By creating an account or using our service, you agree to these terms. Please read them carefully. If you do not agree with these terms, you may not use HarborReel.

Eligibility and Account Creation

You must be at least 18 years old to create a HarborReel account. If you are between 13 and 18, you may use the service only with the involvement and consent of a parent or guardian. Users under 13 are not permitted to use HarborReel.

When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.

Each account is for individual use only. Sharing account credentials with others outside your household is prohibited and may result in account suspension or termination.

Subscription Plans and Payments

Billing and Automatic Renewal

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. Your subscription automatically renews at the end of each billing cycle unless you cancel before the renewal date. We will charge your payment method on file each billing cycle.

Plan Changes and Cancellations

You may change your subscription plan or cancel at any time through your account settings. Upgrades take effect immediately, while downgrades take effect at the start of your next billing cycle. Cancellations stop future charges but do not provide refunds for the current billing period.

Rental and Purchase Transactions

Rental fees grant temporary access to specific content for the stated rental period, typically 48 hours from when you start watching. All rental and purchase transactions are final and non-refundable except as required by law.

Free Trials and Promotional Offers

Free trials and promotional offers are available to new subscribers only, one per user. We may verify eligibility and prevent abuse. Trials automatically convert to paid subscriptions unless canceled before the trial ends.

Content Access and Geographic Restrictions

HarborReel is available exclusively in the United States. Content availability varies based on licensing agreements and may change without notice. We cannot guarantee that specific titles will remain available indefinitely.

You may not use VPNs, proxies, or other methods to circumvent geographic restrictions. Doing so violates these terms and may result in immediate account termination.

Streaming quality depends on your internet connection speed and device capabilities. Minimum speeds and compatible devices are specified in our support documentation.

Acceptable Use and Community Guidelines

Prohibited Activities

You agree not to: use the service for any illegal purpose; share your account credentials with unauthorized users; attempt to circumvent technological protection measures; copy, download, or distribute content except as explicitly permitted; interfere with or disrupt the service; use automated systems to access the service; impersonate others; or harass, threaten, or abuse other users.

User-Generated Content

When participating in community features such as reviews, watchlists, or discussions, you grant HarborReel a non-exclusive, worldwide, royalty-free license to use, display, and distribute your contributions. You are solely responsible for content you post and must not share material that is unlawful, infringing, threatening, defamatory, obscene, or otherwise objectionable.

Content Moderation

We reserve the right to remove user-generated content that violates these terms or our community guidelines. Repeated violations may result in account suspension or permanent ban.

Intellectual Property Rights

All content available through HarborReel, including films, series, artwork, descriptions, logos, and software, is protected by copyright, trademark, and other intellectual property laws. Content is licensed to us by rights holders and is provided for your personal, non-commercial viewing only.

The HarborReel name, logo, and service marks are our property or the property of our licensors. You may not use these marks without our prior written permission.

We respect the intellectual property rights of others. If you believe content on HarborReel infringes your copyright, please submit a DMCA takedown notice to our designated copyright agent as specified in our Copyright Policy.

Service Modifications and Availability

We continuously evolve HarborReel to improve your experience. We may modify, suspend, or discontinue any aspect of the service at any time, including features, pricing, and content availability. We will provide reasonable notice of material changes when feasible.

We strive for reliable service but cannot guarantee uninterrupted or error-free access. Scheduled maintenance, technical issues, and circumstances beyond our control may temporarily affect service availability. We are not liable for service interruptions or data loss.

Account Termination and Suspension

You may terminate your account at any time by canceling your subscription and deleting your account through account settings. Upon termination, you lose access to all content and account data.

We may suspend or terminate your account immediately, without notice, for violations of these terms, suspected fraudulent activity, non-payment, or legal requirements. We may also terminate accounts that remain inactive for extended periods.

Termination does not relieve you of obligations incurred before termination, including outstanding payment obligations.

Disclaimers and Limitation of Liability

Service Provided "As Is"

HarborReel is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will meet your requirements or be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, HarborReel and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use or inability to use the service, even if we have been advised of the possibility of such damages.

Our total liability for all claims related to the service is limited to the amount you paid to HarborReel in the twelve months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless HarborReel and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the service, violation of these terms, or infringement of any intellectual property or other rights of any person or entity.

Dispute Resolution and Arbitration

Informal Resolution

Before filing a formal dispute, you agree to contact us and attempt to resolve the matter informally. Most disputes can be resolved this way. Contact our support team with a detailed description of the issue and your desired resolution.

Binding Arbitration

If informal resolution fails, you agree that any dispute arising from these terms or your use of HarborReel will be resolved through binding arbitration rather than in court, except that either party may seek injunctive relief in court for intellectual property infringement.

Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision is binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

You agree to bring claims against HarborReel only in your individual capacity and not as part of any class, consolidated, or representative action. Class arbitrations, class actions, and representative actions are not permitted.

Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the State of Illinois, United States, without regard to conflict of law provisions. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Cook County, Illinois.

Changes to These Terms

We may revise these Terms of Service at any time. Material changes will be communicated via email or prominent notice on the platform at least 30 days before taking effect. Your continued use of HarborReel after changes become effective constitutes acceptance of the revised terms.

If you do not agree to modified terms, you must stop using HarborReel and cancel your subscription. Cancellation is your exclusive remedy for disagreement with updated terms.

Severability and Entire Agreement

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and HarborReel regarding your use of the service and supersede all prior agreements and understandings.
